This is an extradition case. On December 21, 1948, plaintiff-in-error was arrested on a fugitive warrant alleging that on November 19, 1948, in Cook county, Illinois, he unlawfully, wilfully and viciously assaulted with a revolver one John Clark with intent to kill him contrary to the statutes and against the peace and dignity of Illinois. On December 29, 1948, the Honorable Fred R. Zimmerman, acting governor of Wisconsin, honored the requisition of the governor of the state of Illinois for Kohl's surrender and issued a governor's warrant directing the sheriff to deliver him to the demanding state.
