On August 31, 1967, Bronson C. La Follette, attorney general for the state of Wisconsin, on behalf of the state, petitioned
this court for leave to commence an original action of prohibition to prevent the absolute discharge, except by remand, following
discharge, to the jurisdiction of the juvenile court of originating commitment, of persons prosecuting petitions of in the
circuit court for Brown county based upon the failure of the committing juvenile courts to have accorded petitioners their
constitutional right to counsel. The petition of the attorney general alleged that on August 7, 1967, one Louis Napoleon had petitioned respondent Gleason
as circuit Judge for a writ of against Michael Skaff, warden of Wisconsin state reformatory at Green Bay, claiming his imprisonment
in such reformatory to be illegal under In re Gault, 1 said Napoleon being an inmate of the reformatory placed there by
the state department of public welfare pursuant to commitment by the juvenile court of Milwaukee county; that on August 24,
1967, the circuit court for Brown county ordered Napoleon discharged from custody by respondent Skaff because Napoleon's constitutional
rights as defined under Gault had been denied, and further that Napoleon was not to be remanded to the juvenile court of Milwaukee
county.
